TERMS & CONDITIONS

By accessing the website www.purekaratcreations.com, you agree to the terms and conditions set forth below. This is a legally binding agreement made between Karat Collections (Pty) Ltd and you personally or if applicable on behalf of another individual for whom you are using the site for. By entering the website or creating a profile, you consent to have this agreement provided to you in electronic form. These terms and conditions apply to all purchases, whether made through the website, by telephone, or otherwise. This User Agreement is effective on January 2024, for all users of this website. Because this agreement contains legal obligations, please read carefully before proceeding. Karat Collections (Pty) Ltd is trading as Pure Karat Creations (‘PKC’). Before you may place orders to purchase you must read and accept all of the terms and conditions in our user agreement. By using our website, you represent and warrant without limitation that you have read, understand, and agree to the terms of this agreement.

PKC reserves the right to make any necessary changes to its terms and conditions at any given time without notification and that you agree that we may change the terms at any time. Also, you agree that we may make any changes to the website at our sole discretion, for any reason without providing notice to you. If you use our website after we have posted a change to the terms and conditions, then you have agreed to the new terms and conditions that are present by the most recent version of your terms and conditions.

You must be at least 18 years of age to purchase or use the website of PKC.

Disclaimers

By entering our website you acknowledge that you are the individual making all of your own decisions when purchasing and that we are not influencing or making recommendations as to how you conduct your purchases with us. Also, by entering the site and purchasing you acknowledge that you are aware and assume all of the risks for which you have sole responsibility, associated with purchasing and that PKC is not liable or responsible for any of those risks.

Risks

PKC does not offer investment advice. We also do not guarantee profits on the items that you purchase. PKC expresses no opinion on the soundness of any of your purchases.

Order Policies and Procedures

Upon placing an order to buy a product from PKC, you have entered into a binding and legally enforceable agreement. Availability and pricing are subject to change without notice.

Product Availability

Lead time is dependent on stock availability. Should the product not be in stock please allow a longer delivery time. Deliveries are time sensitive and subject to minting timelines, customs clearance, payment, shipping, storage and checks.

Every effort is made to effect shipment of your order timeously – however unforeseen circumstances may cause delays. Should we be faced with such an occurrence, we will contact you via email and provide a revised shipping schedule.

Please note that, until further notice, all our stock is ordered on a pre-sale basis (as indicated on each product page), meaning that it is not yet in our vault and will need to be ordered. This will have an influence on delivery time, which we endeavour to keep below 30 days from confirmation of your order. In the event that your item(s) is not delivered within a period of 90 days from date of order confirmation, you will be entitled to cancel your order and be refunded.

Payment Options

PKC requires that all payments be made by credit card, debit card, EFT, paypal or crypto. PKC does not accept cash on delivery orders.

Chargeback Policy

You agree not to file a credit card or debit card chargeback regarding any purchase and abide by the dispute resolution procedures listed. In the event that you breach this agreement and file a chargeback, upon a resolution in our favour of the chargeback by either the credit card issuing bank, the credit card processor or by VISA/MASTERCARD, you agree to reimburse us for any costs incurred in researching and responding to such chargeback, including without limitation, our actual costs paid to the credit card processor or our banks, other third parties, and the reasonable value of our time spent on the matter, as determined in our discretion in good faith. You further agree that all dispute resolution procedures below will be deemed waived by you, and that these amounts will be added to the original amount of the order, and that this total amount will then be immediately due and payable. If your chargeback is upheld, you agree to pay all of the same costs, in addition to the original purchase price.

Cancellation Policy

All sales are final. The customer enters into a legally binding agreement once the order is submitted and confirmed, and may not cancel or modify their order afterward. If the customer still insists upon cancellation after the order is placed, a 10% penalty on orders WILL be collected. If the customer paid by card, a 10% fee will be charged to their source of payment and they will be refunded the other 90%.

Documentation

PKC reserves the right to request additional documentation for certain credit card orders or any other orders.
Cancellation of Orders
PKC expressly reserves the right to refuse or cancel any order, for any reason, at its sole discretion, regardless of the payment method and price confirmation.

Collections Expense

In the event that PKC has to take any action against a customer in order to enforce your obligations under this User Agreement, including, without limitation, turning your account over to a collection agency or a lawyer for collection, the customer shall have to pay all of the costs and the expenses incurred by PKC including, without limitation, reasonable attorney fees, in connection with such actions.

Insurance

We provide insurance for free on every package dispatched. Our insurance will only be covered if the item is lost or damaged in transit. We will not be responsible if the package tracking information shows as delivered. Once the item shows that it was delivered as promised as per our tracking information, we are no longer liable for our insurance policy and it is the customer’s responsibility at that point. When we ship the items to you, if the items are damaged or lost in transit, we will accept full responsibility and pursue any claims with our insurance policy. If an item is lost in transit we reserve the right at our own discretion to reship your item or provide you with a refund. Please note that PKC will not be responsible for reimbursements or insurance claims on packages that are successfully delivered as addressed. Our liability and insurance cease the moment the package is signed for or left at the specified delivery address. We currently do not ship internationally. We only sell and ship to clients based within the borders of South Africa.

All prices quoted on our website are in South African Rands. While we work hard to ensure that all of prices are current, discrepancies may occur at times due to product availability and changing market conditions, as well as typographical errors. All our products are bullion products which are constantly changing in price. As a result, the final prices of your items will be determined at the time of checkout. We strive hard to assure the accuracy and information of the products and pricing that we provide on our site. However, pricing or typographical errors may occur at times and in the event that an item is priced improperly due to an error in pricing or information of the product, PKC shall have the right at its sole discretion to cancel or refuse any orders placed on any item. We will notify you via email of such cancellation and do apologise if situations like this arise.

Account Settings and Password

When you register and create a profile with PKC, you will be asked to create a password that will be used to access our website to be able to purchase. It is your responsibility to keep your username and password confidential and when registering, you are designating that you are solely responsible for all activities and transactions that occur under your username and password. Customers should use caution when accessing their account from a public or shared computer so that your password and personal information are not viewable to others. Make sure you fully exit from your account at the end of each session so that unauthorized use of your account is not breached. PKC will not be liable for any damages or losses that may arise from your failure to comply with the provisions above.

The contents on this website are solely intended for informational purposes only. Occasionally information on the website may contain inaccuracies, typographical errors, or other omissions that may relate to availability, pricing, or product descriptions. PKC strives to ensure accuracy on all of the content on the site but it is your responsibility to evaluate the accuracy of all the content available on the site.

Indemnification

You agree to indemnify and hold harmless PKC and its affiliates, directors, partners, managers, officers, and shareholders from and against any and all costs, damages, expenses, liabilities and obligations, including, without limitation, reasonable attorney fees, that you may incur as a result of, or in connection with the use of this website or any violations that may arise from this agreement and or use of our website.

Force Majeure

If PKC cannot perform any obligation hereunder as a result of any event that is reasonably beyond its control, PKC’s delay or failure to perform such obligation shall be excused and PKC shall not be liable for any damages as a result of, or in connection with, such delay or failure to complete the transaction.

Termination of Use

PKC reserves the right and sole discretion to suspend or terminate access to or part of its website at its discretion without any notice or reason. Once suspended or terminated from the use of our website, your right to use our site ceases immediately. PKC will not be liable to the customer or any third party for any damages or claims arising from the termination or suspension of your account. Also, any fraudulent, illegal, or abusive activity may be referred to appropriate law enforcement authorities at our discretion.

Payment Method Options

We accept numerous forms of payment methods. Please make sure to read and follow all the terms of your payment method of choice to ensure that all orders are handled accordingly.

Credit Cards

Please be mindful that all credit card orders must have the same billing and shipping address to successfully place an order. If you’d like to have your package shipped to a different address, please process the order with the EFT payment option.

All EFT payments require a ‘proof of payment’ (not ‘record of payment) to be sent to info@purekaratcreations.com within 60 minutes of placing the order, failing which the order will be cancelled. The order will ONLY be formally accepted once the required funds register in our bank account. The name of the account holder and recipient of the shipping address MUST match the name of the sender that initiated the EFT. If the name does not match, we may ask for additional information to verify your account or may choose to reject the order.

Customers are liable for the paygate/credit card fees of the transaction

Consent

I understand that all the designs and trademarks are registered to Pure Karat Creations and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Pure Karat Creations for any civil action or any legal action deemed necessary against me.
